
Camper/Vehicle means the vehicle you are hiring from Sunflowercampers.com and includes tyres, tools, accessories & all other equipment. PAYMENTS AND COSTS Payments do not include insurance as the cost is specific to the person driving, breakdown cover and unlimited mileage will be included within the insurance premium. Payment can be made using Direct Bank Transfer or PayPal is also an option. Personal cheques are not accepted as payment unless they are cleared 6 weeks before the start date of your holiday. Prices shown on our website are quoted and payable as GB Pounds Sterling. A non-refundable deposit of £ 150 is required upon booking to secure your vehicle. The balance of the price of your hire must be paid at least 6 weeks before your arrival date. If you are booking within 6 weeks of your departure date, full payment is due at the time of booking. If the balance is not paid within this time period, your booking may be cancelled and your £ 150 non-refundable deposit forfeited. Any hire charges published on the website or on any other publication are subject to change without notice. Although, once your booking has been checked and confirmed by you the charges quoted will not change. If you become trapped in mud and need towing out, there will be a reasonable charge based on where you are at the time. All charges and expenses payable by you under this agreement are due on demand by Sunflower Campers. If these payments are not received when due, the customer agrees to pay a late payment charge set at 2.0% per calendar month on the outstanding balance including any costs that Sunflower Campers should incur. If the Hirer is more than one person, each person will be liable jointly and severally for all obligations of the customer pursuant to this agreement. INSURANCE Due to French insurance regulations the following applies: A copy of a valid passport and both sides of your driving license must be provided along with a copy of your proof of 'No Claims' with the return of your booking deposit. Minimum of 7 days hire and multiples thereof. If you have held a full license for 7 years, you can prove a maximum no claims you will benefit from the maximum discount and pay the minimum insurance. If you do not fall into the category above you may still drive our Campers but a small premium may be payable. Please enquire. No other driver will drive the camper unless he/she has full permission from sunflowercampers.com and has filled in the relevant form. The cost of a second driver is £ 20.00 per week. Any unnamed driver would be uninsured and therefore illegally driving. The hirer should have no physical disabilities which prevent them from driving our campers and should not be on any serious medication or under instruction not to drive by a doctor or physician. Insurance excess is set at £750.00. It is possible to half this amount by paying a fee of £ 20 per week. We strongly advise you to take insurance for your personal effects and cancellation. HIRE PERIOD & DURATION Your camper will be ready for collection from 3pm on Friday and should be returned no later than 11:00am on the final Friday of your hire period. Late returns will be charged at £ 25 per hour after the first hour. You must inform us as soon as you are aware that you are going to be late as you may not have insurance cover if you exceed the agreed rental period. No refund can be offered for early returns due to weather, accidents or theft etc. Sunflowercampers.com requires that you return your camper to us in a clean condition with a full tank of fuel and at least one full cannister of gas. Gas cannisters not replaced will be charged at £ 30. Any additional cleaning is charged at £ 15.00 per hour and additional fuel at the current market value, plus a £ 20 administration fee. USE OF THE CAMPER Whilst you are hiring the vehicle you agree that you will not: Drive other than on a paved public highway, private road, or driveway. i.e. on the beach. Use for any hire or reward, including racing, pace making, rallying, reliability trials, and speed testing. Tow any vehicle or trailer. Drive whilst under the influence of drink or drugs. Leave the vehicle unlocked while unattended, or fail to secure the keys. Drive in a reckless manner. Repairs are expensive and will be charged to the customer if it is deemed that vehicle has been used in an improper manner. Carry more passengers than permitted. Allow the vehicle to be overloaded. Carry passengers or goods for hire or reward. Smoking is absolutely forbidden in our campers. Drive the camper outside France unless we have given specific permission in writing. Your insurance may be invalid. Drive the camper without checking that the oil level is maintained on a daily basis. Engines are also very expensive. We are sorry but no pets are allowed in our vehicles as it may not be appropriate for subsequent hirers. SECURITY DEPOSIT A £ 750.00 Security Deposit is payable by cleared Personal Cheque, Bank Transfer or PayPal (costs apply). This will be returned to you on return of the camper to Sunlowercampers.com, at the end of your hire period. Presuming the camper is in the same clean condition as it was hired to you, with the toilet empty (If applicable), the interior clean including all cooking appliances and optional extras. The fuel tank full with the appropriate fuel. (Sans Plomb 95/98). Empty gas cannisters recharged. Any costs incurred by Sunflowercampers.com will be debited from your security deposit. We also reserve the right to retain monies from your security deposits as follows: You agree that you will reimburse in full any sums due to us should your Security Deposit not be sufficient to cover the cost of any damage or other costs as set out in these Terms & Conditions. You are liable for the full rental cost of the vehicle while off road for repairs. You agree to indemnify us for all costs, damages expenses claims and losses which we incur, suffer or become responsible for as a result of any act or omission by you which results in our being unable to receive full payment for such costs, damages, expenses claims and losses under the insurance cover, or for which we are unable to receive full payment under the insurance cover. CANCELLATIONS The following scale is provided for cancellations. Cancellations made 6 weeks or more before your date of hire - Loss of security deposit. Cancellations made between 4 and 6 weeks before your date of hire will incur a charge of 50% of total cost. Cancellations made between 2 and 4 weeks before your date of hire will incur a charge of 75% of total cost. Cancellations made less than 2 weeks before your date of hire will incur a charge of 100% of total cost. We would suggest that you take out independent holiday cancellation insurance to cover any losses. BOOKING ALTERATIONS If you need to alter your booking, we will endeavour to accommodate your needs at no extra cost. However, if this is not possible then further charges may apply. IF WE CHANGE OR CANCEL YOUR BOOKING Should the vehicle you have chosen to hire be damaged by a previous customer or be out of service, we will hire you another camper assuming that there is one available. If there are no other campers available, you will receive a 100% refund. Sunflowercampers.com regret that they cannot and will not be liable for any other costs incurred by the customer relating to ferry/flight bookings or any other costs. IF YOU SHOULD BREAKDOWN Every effort is made to ensure that your camper is reliable and is serviced regularly. However in the unlikely event that you breakdown, you should seek the help of the breakdown services. Your insurance includes breakdown cover. You are authorised to approve repairs up to 100Euros. Any repairs in excess of 100Euos must first be authorised by us, prior to the work being undertaken. In all cases receipts must be submitted for any repair or the claim will not be paid. You and not us will not be liable for the cost of any repairs, or other costs incurred, resulting from reckless, negligent or imprudent use of the vehicle by you or permitted by you. You will notify us by telephone of the breakdown. We can then attempt to resolve the problem as quickly as possible. If a repair cannot be completed within 24 hours, and it is not the result of reckless, negligent or imprudent use of the vehicle by you or permitted by you. We will endeavour to help by providing a replacement camper (subject to availability) on the realisation that the breakdown was not caused by improper use. Should you fill the vehicle with the incorrect fuel, you will be liable for all costs, including draining the tank and any subsequent loss of rental time after your hire period. IN CASE OF ACCIDENT If you are involved in a motor vehicle accident the following procedures should be followed: You should complete the form provided with all the relevant details of the other party and any witnesses. We will run through the form with you before you set off. If anyone has been injured you should report the incident to the police immediately. Do not accept blame or insist the other party is at fault. If possible photograph damage to all vehicles involved and registration numbers. This will depend on how much of your holiday remains and who was at fault. We will endeavour to ensure any money due back to you is forwarded as quickly as possible; sometimes, however, third party claims can take a while to resolve. You agree to provide all reasonable assistance to Sunflowercampers.com in handling any claim including providing information and attending Court to give evidence. PUNCTURES AND OR TYRE DAMAGE You are liable for the cost of any tyre damage or punctures. You will arrange for the puncture to be repaired, or the tyre replaced, as soon as possible after the incident. If the camper is returned with a damaged tyre, it will be our decision whether or not to replace or repair the tyre. We have to think of the safety of our subsequent hirers. ADDITIONAL HIRER LIABILITIES Any fines or penalties resulting from speeding, parking tickets or any other road traffic misdemeanour. There may also be an administration charge. The cost of replacing keys, which have become lost or stolen, or which have been locked in the vehicle. YOUR AGREEMENT Your agreement is with Sunflowercampers.com. Your contract with us commences upon receipt of the non refundable deposit and confirmation of your booking with us. It is important that you read and check your booking confirmation upon receipt. If there is an error in your booking you should contact us immediately as late changes will be subject to availability and may not be possible. If the terms and conditions of this agreement are not adhered to, we reserve the right to cancel the agreement without refund or compensation. TERMINATING THE AGREEMENT You acknowledge that we may terminate this agreement and repossess the vehicle at any time if we feel that: The terms and conditions have not been adhered to. You are in contravention of this agreement in any manner. We believe that you have hired the vehicle through fraud or misrepresentation. The vehicle appears to be abandoned. The vehicle is not returned on the agreed day. We believe that the vehicle may not be returned on the agreed date. On reasonable grounds, we believe that the safety of the passengers or condition of the vehicle is endangered. You understand that, in the event of such termination or repossession except as otherwise expressly set out in these terms and conditions you have no right to a refund of any of the rental charges or, if costs are incurred, the security deposit. This agreement constitutes the entire agreement of the parties and there are no other undertakings or agreements between the parties relating to the subject matter of this agreement. We reserve the right to vary the rates and conditions of hire at any time. If the camper is stolen as a result of keys being left in the vehicle whilst it is unoccupied is not covered by the insurance. Damage to windows or a windscreen is not covered by standard insurance if this is the only damage to the vehicle. Any claim on insurance will not be considered if the vehicle was being used in contravention to these terms and conditions. The damage excess charge is applicable regardless of who is at fault. The damage excess charge will be refunded only if we are successful in recouping the costs from the third party. DEFINITIONS OF RENTAL AGREEMENT Sunflowercampers.com is owned by Philip and Heather Holloway-Smith. The 'customer', 'hirer' or 'you' refers to the person/s hiring the Camper and entering their details on the Rental Agreement and Insurance Agreement. 'Agreement' refers to the rental agreement and 'Insurance agreement' and the 'Terms and Conditions' herewith. These 'Terms and Conditions' take prevalence over all other literature. 'Optional Extras' refer to any of extra equipment you agree to hire. 'Hire Period' refers to the time that the Camper is in the hirers' possession and control. 'Camper' or 'Vehicle' refers to the Camper you have elected to hire or any other subsequent replacement vehicle. To include accessories, tyres, optional extras and tools. |
